I get that from a legal perspective, starting sex while someone is asleep is non‑consensual. But in the story it’s shown as them already being in love and finally together after being apart. The bottom doesn’t feel hurt or violated, he’s just happy they’re close again. Ofc it’s still wrong no matter how you view it, but the scene is written to show love and reunion, not to ignore consent, which is probably why people are interpreting it more as passion than violation.
I agree that in 99.9999% of situations, you shouldn't start having sex with a sleeping person without first waki g them up to gain consent. But on the other hand when he woke up, was he mad? Did he feel violated? Or was he like, "What?? You're home already? I missed you! Let's keep having sex!!" Cuz that matters.
When you're in a committed relationship, the line is a bit more blurry. It's about knowing your partner intimately and understanding whether they would consent or not in that circumstance... Whether this would be a welcome surprise or not. Is it a dangerous game to play? Yes. But in this case our uke was clearly down for the surprise and it became fully consensual very quickly.
