Although I see how it could be understood that way, to me it seems more like coercion than consensual sex. The brother had a position of power over mc, for various reasons (he was older, mc didnt feel like he was treated like part of the family by the parents, and the mc wanted to earn his affection at all costs, among other reasons) and if the two partners aren't equal in their relationship, it's unhealthy and most likely not consent.
