More like guilt? He did consent to have sex but the guy was convicted for sexual assault too. He felt guilty to make him go in for something he didn't do. Even when he might've attempted to murder a guy, he didn't really rape him. Unless you're talking about him asking for it to stop during sex.

No, it certainly *is* rape, by law and common sense. (Though I suppose in manga it's become so common that people are begging the other to stop and being ignored that one almost tends to not even consider it anything out of the ordinary there anymore... Σ(¬＿¬) ).
Not to mention the many other cases of sexual assault before that in the story, when he violently forced himself on Jeongin and did whatever the hell he wanted, ignoring any protests.
