Rape through substance happens when someone is so intoxicated that they can't physically/verbally stop what's going on, or they're so out of it they don't realize what's going on at all. The rape factor isn't whether they remember it or not (since nobody is able to foresee that) but whether there was consent before initiating the act. Seeing they've been a couple for years, they do not need verbal consent anymore, especially when Aya is the one who initiated it. There was implied consent from both sides, therefore it's not rape whether they remember it or not.

Second of all, even if they're in a relationship for too long that doesn't automatically mean consent. "especially when Aya is the one who initiated it" this statement doesn't prove anything because of your first statement. Also a long-term relationship does not create permanent or blanket consent. Initiating a kiss does not equal consenting to sex, and prior sexual history cannot replace present consent. So to conclude it all If someone is so intoxicated that their judgment and capacity to make decisions are significantly impaired, relying on "implied consent" is unsafe and legally and ethically questionable. The key issue isn't whether they remember the event but whether they had the capacity to voluntarily and knowingly consent to sex at that moment.

I think it's not rape more on like non consensual sex but it did show Aya getting drunk. Gurl i study pharmacy and i knew alcohol can't make you conscious enough to properly consent if it is consumed in high amount or if the person has low tolerance against ethanol

We saw Aya actively asking for a kiss. We then see them kiss and the chapter ended, implying that something sexual happened. I just don't understand why your first thought would be that whatever happened wasn't consensual when Aya was most likely the one who asked for it, or otherwise fully able to ask for it to stop.
