1. Dane kidnapped Grayson in a way which could qualify as attempted murder, and well he kidnappened him. Both are crimes. And that is where is started.
2. Grayson then locked them up, but never intended to rape Dane. And the way he reacted to Dane in heat made it actually pretty clear.
3. Grayson in the novel made pretty clear that he does not consent in general, no matter if top or bottom. That was at a point where Dane already decided to bottom.
Dane used his pheromones to knock him out and the next thing Grayson knew was that Dane strangled his poor Virginia and he was in rut.
