This phenomenon is called sexual assault by incapacitation, or more specifically, drug- or alcohol-facilitated sexual assault (DFSA).

In legal, ethical, and psychological terms, taking advantage of someone in this state is classified as rape.

Why this is legally and ethically classified as Rape:

1. Lack of Capacity to Consent: A person who is going in and out of consciousness or is severely intoxicated is mentally and physically incapacitated. By law, an incapacitated person cannot grant legal consent.

2. Physical Vulnerability: The physical sensations; feeling overly warm, finding comfort in a cold floor or a passing touch, are physiological reactions to severe alcohol or drug poisoning, not a conscious or coherent invitation for sexual activity.

3. The Perpetrator's Accountability: When one party knowingly initiates sex with someone who is clearly vulnerable, impaired, or drifting out of consciousness, the law defines it as an act of sexual violence. The initiator is entirely responsible for committing the assault.

Actually its the third time!
