I think the OG MC might have given up the mine way earlier than MC cuz she didn't know any better/to please her in-laws. She married to cover her 'family's' debt so she'd have wanted to stay on good terms with her husband's family. If she'd signed away her only wealth, then filing a divorce would be the same as becoming homeless, if she even succeeded. OG MC didn't know anything about the hidden prince, the lawyer or even the butler to get their support, so she'd be facing a powerful count family with no backing. It's far more likely that she'd be completely ignored at best or thrown into a sanitorium for 'hysteria' at worst.
