It's basic consent 101. If one party is so insanely intoxicated and one isn't , there's an established issue there.
Consent requires clear, willing agreement, and if one party can't legally consent due to being passed out, unconscious, or mentally incapacitated by alcohol, (which is what's happening here) , the sober person is legally responsible for the act, as they should have recognized the incapacity and not proceeded
Any act that explore the body of someone especially sexual act, requires a very hard, clear consent.
If it's a no then it's a no.
If it's a hesitant yes then it's a no.
If it's anything but a clear and enthusiastic yes, (enthusiastic as in both or all party involved fully knowing the repercussion (?), affect etc) then it's a no.
