If this were to happen in real life, it would most definitely be rape. Legally, morally whatever. Whether the victim chooses to report the crime or not is up to them, however it doesn't erase the fact that they were violated and assaulted.
PS. to say that it's only the victim who decides if it's rape or not is wrong. Rape is rape...
